1. Acceptance of These Terms

By visiting https://tmg.wpcodix.com (the “Site”), creating an account, or purchasing any digital products or services (collectively, the “Services”) from The Match Guy LLC, a Pennsylvania limited-liability company (“The Match Guy,” “we,” “us,” or “our”), you agree to these Terms and Conditions (“Terms”). If you do not agree, do not use the Site or Services.

These Terms incorporate by reference our Privacy Policy, Cookie Policy, and any service-specific terms displayed at purchase. Together they constitute the entire agreement between you and the Company.

2. Key Definitions

Term	Meaning
User / you	Any individual or entity who accesses the Site or purchases Services.
Digital Content	All courses, live sessions, recordings, videos, blogs, PDFs, templates, and other non-tangible materials we deliver.
Account	The personal profile you create to access restricted areas of the Site.
Subscription	A Service billed on a recurring basis as shown at checkout.

3. Scope of Services

The Match Guy provides educational consulting for medical students and graduates and other healthcare professionals, including USMLE and residency-match guidance, finding U.S. clinical rotations, educational courses, and other related services. No physical goods are sold. We may revise, replace, or discontinue any part of the Services at any time without liability.

4. Eligibility & Accounts

Age. Services are intended for adults. Users under 18 may use the Site only with parent or guardian consent; the guardian agrees to these Terms on the minor’s behalf.
Account Security. You are responsible for safeguarding credentials and all activity under your Account. Notify info@tmg.wpcodix.com of any unauthorized use.
One-Account Rule. Creating multiple Accounts to bypass limits or payment obligations is prohibited.

5. Intellectual-Property License & User-Generated Content

5.1 Proprietary Materials

All content on our Site—including courses, videos, live sessions, written guides, templates, blog articles, and other materials—is owned by or licensed to The Match Guy LLC and protected by U.S. and international copyright, trademark, and intellectual property laws.

You may access and use this content for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or share our content in any form, whether online or offline, without our prior written consent. Unauthorized use of our intellectual property may result in legal action.

5.2 Account Sharing and Course Access

Account sharing, resale, or unauthorized distribution of our content is strictly prohibited. Course or live sessions or digital content access is granted solely to the person who purchased the Service or Course. Sharing your login credentials, downloading content for others, allowing others to access your account, or copying and distributing our materials without permission violates these Terms and applicable law.

The Match Guy reserves the right to suspend or terminate your account without refund and pursue legal action for any such violations, including seeking damages, attorney’s fees, and other costs of enforcement.

5.3 User-Generated Content (UGC)

If you post or upload comments, forum entries, testimonials, or other content (collectively “UGC”):

You retain ownership but grant us a world-wide, royalty-free, perpetual license to use, display, reproduce, and distribute the UGC in connection with the Site and our marketing.
You represent that your UGC does not infringe third-party rights.
We may remove UGC at any time in our sole discretion.

5.4 DMCA / Copyright Notices

We respect intellectual property. If you believe content on the Site infringes your copyright, send a notice to info@tmg.wpcodix.com with the information required by 17 U.S.C. §512(c)(3). We will respond promptly as required by the Digital Millennium Copyright Act.

6. Pricing, Payments, Subscriptions

Prices are in U.S. dollars unless stated otherwise.
Payment Methods: major cards and processors listed at checkout.
Subscriptions & Installments. By enrolling you authorize recurring charges until cancelled under the plan’s terms. Failed payments may suspend access.
Electronic Communications Consent. By purchasing or creating an Account you agree we may send you transactional emails, SMS, push notices, and other electronic communications. You also consent to electronic records and e-signatures.

7. Refund Policy & Non-Refundable Fees

Refund Policy — All sales are final unless a specific course or service page explicitly offers a refund window.
Transaction Fees Non-Refundable. Third-party processing fees (typically 4–5 %) are never refundable, even when we issue a discretionary refund.

8. No Guarantee of Results & Educational-Only Services

We want to set realistic expectations. All of our courses, one-on-one advising sessions, written guides, videos, and other Digital Content are offered solely for educational purposes—to help you gather information and develop strategies. We do not and cannot promise, warrant, or guarantee any particular outcome, including (but not limited to):

A specific USMLE® Step score or pass/fail result;
An interview invitation from any medical residency or fellowship program;
A successful match through the National Resident Matching Program® (NRMP) or any other match service;
Acceptance to, or visa sponsorship from, a U.S. hospital, clinic, or research institution;
The timing or approval of any immigration or licensing application; or
Employment, promotion, academic credit, or publication as a result of our guidance.

8.1 Factors Outside Our Control

Success in medical licensure exams and residency applications depends on numerous elements that are beyond our influence, including but not limited to:

Your prior academic record, clinical evaluations, and research output;
Your test-taking skills, mental health, study habits, and time commitment;
Visa status, geographic preferences, program quotas, and changing immigration rules;
Evolving examination content and NBME®/USMLE® scoring policies;
The subjective judgment of program directors, interviewers, and credentialing committees; and
Unforeseen events such as illness, personal emergencies, or regulatory changes.

Because these variables are unique to each applicant and frequently unpredictable, no reputable advisory service can guarantee results.

8.2 Nature of Our Advice

Our mentors draw on substantial clinical, academic, and admissions experience. Nevertheless, professional opinions differ. Another advisor might reasonably suggest a different approach for the same candidate. You understand that:

Advice we provide is an opinion, not an assurance.
You remain solely responsible for deciding which recommendations to implement and for timely completion of your applications, examinations, and paperwork.
You should independently verify deadlines, eligibility criteria, and document requirements with official sources (e.g., ECFMG®, NBME®, ERAS®, NRMP®).

All Services are delivered in a manner consistent with the ethical guidelines of the American Medical Association and other applicable professional standards. Nothing herein creates a physician-patient relationship or constitutes medical, legal, immigration, or financial advice.

Any guarantee advertised on a specific service page is governed solely by the terms on that page.

8.3 Limitation of Remedies

To the fullest extent permitted by law, your exclusive remedy for dissatisfaction with the Services is to stop using them. Any monetary claims are limited as set forth in Section 10 (Limitation of Liability).

9. User Conduct

You agree not to:

Violate any law or these Terms;
Share course materials or credentials;
Infringe IP rights;
Use bots, scrapers, or interfere with Site functionality;
Upload malicious code. We may suspend or terminate access for violations without refund.

10. Disclaimers, Force Majeure & Limitation of Liability

Disclaimer of Warranties. To the fullest extent permitted by law, The Match Guy disclaims all warranties, express or implied
Force Majeure. We are not liable for delays or failures or data loss or other issues caused by events beyond our reasonable control, including but not limited to acts of God, internet outages, or government actions.
Security Measures: We implement reasonable administrative, technical, and physical safeguards. We strive to protect your personal data and application information, but no system is entirely immune to breaches. While we take appropriate precautions, we cannot guarantee absolute security. To the fullest extent permitted by law, we are not responsible or liable for any unauthorized access, disclosure, loss, or destruction of personal data caused by circumstances beyond our reasonable control.
Trademark Notice: USMLE®, COMLEX-USA®, NBME®, NRMP®, ECFMG®, and ERAS® are registered trademarks of their respective owners. The Match Guy LLC is not affiliated with or endorsed by these organizations.
Data Retention Disclaimer: We strive to retain personal data only as long as necessary for the purposes described in our Privacy Policy. However, due to system backups, legal obligations, and operational constraints, some data may remain archived in secure storage for longer periods before it is permanently deleted or anonymized. We do not guarantee immediate deletion of all data upon request but will comply with applicable legal timeframes.
Limitation of Liability. To the fullest extent permitted by law, our total liability for any claim will not exceed the amount you paid us for the Service giving rise to the claim. We are not liable for consequential or punitive damages.

11. Indemnification

You will indemnify and hold harmless The Match Guy and its officers, employees, and affiliates against any claims or expenses arising from your use of the Services or violation of these Terms.

12. Termination

We may suspend or terminate your Account at any time if we believe you violated these Terms. Upon termination, licenses granted to you end immediately.

13. Affiliates & Third-Party Links

Some links on the Site are affiliate links; we may earn a commission if you purchase through them. This does not affect the price you pay. The Site may link to third-party websites; we do not endorse or assume responsibility for their content.

14. Assignment & No Partnership

We may assign these Terms to a successor in interest (e.g., merger or asset sale). You may not transfer, sell, sublicense, or otherwise assign any of your rights or obligations under these Terms—including your account, subscription, or access to course materials—to another person or entity unless we have first given you express, written permission to do so.

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and us.

15. Dispute Resolution: Informal Process, Small Claims & Arbitration

Informal Resolution (Required First Step). Before taking any formal action, you agree to email info@tmg.wpcodix.com and provide a brief written description of the dispute. We will attempt to resolve the issue within 30 days.
Small-Claims Court Exception. Either party may bring an individual claim in the small-claims court of Allegheny County, Pennsylvania if the claim qualifies under that court’s monetary limits. The informal-resolution requirement above still applies.
Binding Arbitration for All Other Claims. Any dispute not resolved informally or in small-claims court shall be settled by binding arbitration administered by the AAA under its Commercial Arbitration Rules. The arbitration will be conducted by video conference or, if the arbitrator deems an in-person hearing necessary, in Pittsburgh, Pennsylvania.
No Class or Representative Actions. You and The Match Guy agree to bring claims only in an individual capacity, not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate claims of multiple parties.
Costs & Attorney Fees. The cost of arbitration will be handled in line with the procedures set by the American Arbitration Association (AAA). Unless the arbitrator determines otherwise, both you and The Match Guy are responsible for covering your own legal expenses and related fees.
If you access or use our website without purchasing any of our services, you agree that you are not eligible to bring any legal claims, class actions, or seek remedies of any kind—monetary or equitable—against The Match Guy LLC in any forum.

16. Entire Agreement, Severability & Waiver

These Terms, together with policies referenced herein, and any signed written contracts with The Match Guy, constitute the entire agreement between you and The Match Guy and supersede prior discussions. In the event of any conflict between these Terms and Conditions and any other policy, statement, or agreement posted on our Site (including but not limited to the Privacy Policy and Cookie Policy), these Terms and Conditions will control to the extent permitted by law. If any provision is held unenforceable, the remaining provisions remain in force. Our failure to enforce any right is not a waiver of future enforcement.

17. Changes to Terms

We may update these Terms at any time. Material changes will be clearly posted on this page with an updated effective date. By continuing to use the Site after such changes, you agree to the revised Terms. We do not send individual email notifications of changes.
